Assault is a felony if the person:

19. Strangles the victim and the assault involves domestic abuse.

§ 3.27 Felonies

Any offense expressly defined as a felony shall be subject to a term of imprisonment of not more than 3 years or a fine of $15,000, or both. A total term of imprisonment for any criminal proceeding shall not exceed 9 years.

A defendant shall not be subject to felony prosecution unless the defendant:

has been previously convicted of the same or a comparable offense by any jurisdiction in the United States, including tribes; or

is being prosecuted for an offense comparable to an offense that would be punishable by more than 1 year of imprisonment if prosecuted by the United States or any of the States.
