Lac du Flambeau Tribal Code, ch. 70 § 70.301 (2007)

§ 70.301 Crimes

All provisions of Chapter 940, 941, 942, 943, 944, 945, 946, 947, 948, and 951 of the Wisconsin Statutes, including non-criminal provisions, are incorporated by reference as if fully set forth herein, except that any references to 6 penalties for violations of the provisions are governed by this ordinance. Any non-criminal provisions that are adopted shall be punishable by a civil remedial money penalty not to exceed ($500-$5000.000).

 

Wisconsin Law:

WI. STAT. ANN. § 940.235. STRANGULATION AND SUFFOCATION

(1) Whoever intentionally impedes the normal breathing or circulation of blood by applying pressure on the throat or neck or by blocking the nose or mouth of another person is guilty of a Class H felony.

(2) Whoever violates sub. (1) is guilty of a Class G felony if the actor has a previous conviction under this section or a previous conviction for a violent crime, as defined in s. 939.632(1)(e)1.
